In the Name of God Amen I, John Hathornthwaite of Forton in the County o f Lancaster Gentleman being poorly in health but of sound and disposing M ind Memory and Understanding Do for the settling my Temporal Concerns m ake publish and ordain this to be my last Will and Testament As Follows – A nd First it is my Will and Mind and I do hereby order and direct that a ll my Just Debts which I shall owe at the time of my decease to any Per son or Persons whomsoever my Funeral Expences and the Charge of the Pro bate of this my Will and all such Charge Loss and Expence as my Executo rs hereinafter named shall or may sustain or be anyways put unto or des erve to have for their Trouble in and about the Execution of this my Wi ll shall in the first place be paid of and discharged forth and out of m y personal Estate and Effects And as for and Concerning all my Messuage s and Tenements with the Appurtenances and the several Closes Closures p ieces or parcels of Land thereunto belonging situate lying and being in F orton aforesaid and Ellel in the said County of Lancaster I do hereby G ive Devise and Bequeath the same and every part thereof unto my Son Dav id Hathornthwaite his Heirs and Assigns forever Charged and Chargeable n evertheless with the payment of the Sum of Fifty Pounds of lawful Money o f Great Britain yearly and every year unto my loving wife Ellen and her A ssigns for and during the term of her natural  life by four Quarterly p ayments in the year the first payment thereof to begin and be made at t he end of three months next after my decease and to be continued Quarte rly during the life of my said wife Ellen clear of all present or futur e Parliamentary or other [Pays?] Taxes Charges Assessments or other Out goings whatsoever Ordinary or Extraordinary     Provided Always that if i t shall happen that the said Quarterly payments or any of them shall be b ehind or unpaid by the space of ten Days next after the Days or times h erein before limited or appointed for payment thereof That then and so o ften it shall and may be lawful to and for my said Wife Ellen and her A ssigns into the said premises or any part thereof to enter and disstrai n for the same and every part thereof and the Distress and Distresses t hen and there found to lead drive Carry away and Impound and the same I mpound to detain and keep or otherwise to dispose of according to Law u ntil the said Quarterly payments and every part thereof and all Costs a nd Charges in and about the taking keeping and disposing of such Distre ss or Distresses shall be satisfied and paid unto my said Wife Ellen an d her Assigns and for Nonpayment thereof to Cause the said Distress or D istresses to be appraised and Sold for the best price or rate and Most M oney that can be had or gotten for the same towards the satisfying all s uch Arrears Costs and Charges Concerning the same Distress or Distresse s the same to be in Full Satisfaction of all Dower or Thirds at Common L aw which she the said Ellen might have or claim from the said messuages T enements Lands Grounds and premises before mentioned  And also Charged a nd Chargeable Nevertheless with the payment of the Sum of Four Hundred P ounds to my Daughter Jennet the Wife of Richard Whitehead of Cockerham i n the said County Gentleman and her legal Representatives And to my Dau ghters Mary, Elizabeth and Easther the Sum of Four Hundred Pounds a pie ce all which said Legacies to be paid to the several Legatees at the en d of twelve months next after my decease but if any of my said Daughter s Mary, Elizabeth and Easther shall happen to die before they shall res pectively be entitled to receive the same and shall happen to Marry and l eave any Child or Children lawfully begotten then and in such case I do h ereby order will and direct that the share or part of such of my said D aughters Mary, Elizabeth and Easther so dying shall go and be paid to s uch Child or Children if more than one equally amongst them   And I do h ereby Give and Bequeath to each of my said Daughters Jennet Mary Elizab eth and Easther one Feather Bed and Bedding thereunto belonging   And a s for and Concerning All the Rest Residue and Remainder of my Estate an d Effects whatsoever wheresoever and of what Nature Kind or Quality soe ver the Same may consist of I Give and Bequeath unto my said son David h is Executors Administrators and Assigns for ever      And Lastly  I do h ereby Nominate Constitute and Appoint my said Son David the said Richar d Whitehead and Robert Bradley of Slyne in the said County Gentleman Jo int Executors of this my last Will and Testament  hereby Revoking all a nd evry Former Will and Wills by me at any time heretofore made and I d o declare this alone to be my last Will and Testament.     In Witness w hereof I the said John Hathornthwaite the Testator have hereunto Set my H and and Seal the Twenty ninth Day of [May?] in the year of our Lord On T housand seven Hundred and Ninety Six 1796
