In the name of God amen I John Hathornthwaite of Bolton by the Sand s in the County of Lancaster yeoman being aged and much indisposed in h ealth yet of sound perfect and disposeing mind and memory (praised be G od for the same) doe make this my last will and testament in manner & f orme following Revoking and hereby making void all former & other will & wills by me at any time heretofore made published or declared   And fir st it is my will and mind and I doe hereby give and bequeath unto James H athornthwaite of Quarmore & James Haighton of Longridge my nephews all m y Goods Chattels & personal estate whatsoever   And alsoe I give and de vise unto them the said James Hathornthwaite and James Haighton their H eirs & Assigns for ever All that my messuage & Tenement with the appurt enances in Bolton aforesaid which Thomas Pool now farmes of me containe ing by Estimation Twelve acres of Land or thereabouts be the same more o r less and alsoe all those my several closes with the appurtenances the reto lyeing & being within Bolton aforesaid called and commonly known b y the names of the Inglebrecks the Walls & the Natrow Meadow containing b y estimation ten acres & a half or thereabouts be the same more or less i n trust nevertheless and to the end intent & purpose that they the said J ames Hathornthwaite & James Haighton & the survivor of them their or hi s Heirs and Assigns shall with all convenient speed after my death sell & d ispose of all my said real & personal estate and out of moneys by such s ales arising pay and discharge all my just debts & funeral expences and t he surplus of the moneys after my debts and funeral expences first ther eout paid I doe hereby order & direct my said trustees to pay unto my s on John Hathornthwaite when he shall attain the age of twenty two years a nd if he happen to dye before he comes to that age I doe hereby order t hem my said trustees to pay the surplus of the said moneys to be raised a s aforesaid unto my daughter Nancy her Executors or Assigns  And furthe r it is my will and mind and I doe hereby order & direct that my said t rustees James Hathornthwaite & James Haighton and the survivor of them s hall stand and be possessed of all the remainder of my messuages lands a nd hereditaments at Bolton aforesaid and also of all those my severall m essuages & tenements with all the appurtenances called & commonly known b y the names of Lanshaw Blindhurst & Waters & receive the yearly rentes i ssues & profits thereof & thereout pay yearly unto my son John the sume o f twelve pounds unto my daughter Elizabeth the sume of six pounds and t o my daughter Nancy the sume of twelve pounds the first payment to comm ence & begin at the end of twelve months next after my death and soe to b e continued till my son John attain to the age of twenty two years   An d then it my will and mind andI doe hereby give and devise unto to my s aid son John his Heirs & Assigns forever if he live to the said age of t wenty two years all my messuages lands tenements & hereditaments whatso ever not herein before devised to my said trustees to be sold charged n evertheless with the payment of three hundred pounds unto my said daugh ter Nancy her Executors or administrators and with the sum of one hundr ed & twenty pounds to my daughter Elizabeth her Executors or administra tors within one month next after he shall be of the age of twenty two y ears  And in case my son John happen to dye before he be of the age of t wenty two years then I doe hereby give &devise all my sd messuages land s tenements & hereditaments herein before limitted to him unto my said d aughter Nancy her heirs & assigns charged with the sume of three hundre d pounds to Elizabeth my daughter upon the death of my said son John  A nd I doe hereby order my said trustees to pay unto my son John when he a ttains to the age of twenty two years if he soe long live and in case o f his death to my daughter Nancy all such sume or sumes of money as the y shall have in their hands by virtue of any power to them given by thi s my will after their necessary charges first thereout deducted and las tly I doe hereby nominate & appoint them the said James Hathornthwaite & J ames Haighton Executors of this my last will and testament hopeing they w ill carefully performe the same as my trust is in them reposed   In wit ness whereof I have hereunto putt my hand & seal the nineth day of Sept ember Ano Dono 1730

Codicil

Be it known unto all men by these presents that whereas I John Hathornt hwaite of Bolton by the Sands in the County of Lancaster Yeoman have ma de and declared my last Will and Testament in writeing bearing date the n ineth day of September in the year of our Lord God 1730 I the said John H athornthwaite by this present codicil do confirme and ratify my said Wi ll and Testament  and do hereby give and bequeath unto my well beloved s on John Hathornthwaite my Grey Filly also all those my standing goods h erein hereafter expressly named that is to say All my Arks both in my d welling houses and Barns, all my Fire Irons, and my Chest and Desk stan ding in my room over the house, and the bedsteads and hangings or curta ins thereto standing in my best room, and also my bedsteads and hanging s or curtains thereto standing in my room over the house where I usuall y laid, my Table in the house and my dresser in the house, all the shel ves in the buttery,and other [nail fast] goods in my house whatsoever a nd all my books:  Itm  I give and bequeath and I hereby declare my will a nd mind is that my two well beloved daughters Elizabeth Hathornthwaite a nd Ann Sparling wife of Richard Sparling of Beaumont Cote have all the r est and remaining part of my househould goods of what kind soever equal ly between them, to be equally divided between them in two parts immedi ately after my decease, and my Executors not to meddle therewith or any p art thereof though it be otherwise set forth in my above said last Will a nd Testament: Itm   I hereby declare that it also is my will full mind a nd order that my said son John Hathornthwaite and also my daughter Eliz abeth Hathornthwaite have a sufficient and commendable maintenance out o f my personality in my Executors power until the issue and profit of th eir portions severally become due & payable;  And my will and meaning i s, that this Codicil or Schedule be and be adjudged to be part and parc el of my said last Will &Testament and that all things herein contained a nd mentioned be faithfully and truly performed as fully and amply in ev ery respect as if this same were so declared and set down in my said la st Will and Testament ; in Wittness whereof I the said John Hathornthwa ite have hereunto set my hand and seal this twelfth day of September in t he year of our Lord God 1730
