Will of Nicholas Hathornthwaite of Lower Lee, 1758

I Nicholas Hathornthwaite of Lower Lee in Overwyresdale in the County o f Lancaster Yeoman do make this my last Will and Testament in manner an d form following (that is to say) first I give and bequeath unto my bel oved wife Jane Hathornthwaite the yearly Sum or Annuity of twelve pound s of lawful money of Great Britain to be paid to her by four quarterly p ayments during her natural life for and in lieu of her dower or third o f Common Law from and out of my Estate and Lands of Inheritance I al so give unto my said wife the new dwelling house I have lately erected a t Lower Lee aforesaid on the opposite side of the road to the dwelling h ouse where I now inhabit during her natural life and do likewise give u nto my said wife the sum of fifty pounds together with the best bed bed stocks hangings and best furniture that I have in any one room at Lowe r Lee aforesaid I do also give and bequeath unto my oldest Daughter A nn Hathornthwaite the Sum of three hundred pounds of lawful money to be p aid to her within twelve months next after my decease with the interest f or the same after the rate of four pounds by the year for one hundred p ounds to commence from the time of my decease and continue till payment s hall be made thereof I do also give and bequeath unto my two younger D aughters Elizabeth Hathornthwaite and Margaret Hathornthwaite the Sum o f three hundred pounds each, to be paid to them when they shall several ly Attain their respective Ages of twenty one years and to each of them t en pounds yearly as interest for each of their respective Legacies from t he time of my decease till payment thereof for and towards their mainte nance and education And in case either or both of my younger Daughte rs Elizabeth Hathornthwaite and Margarett Hathornthwaite shall happen t o die under the age of twenty one years and unmarried then and in such c ase I give her or their portione or portiones so dying equally betwixt m y Son and Surviving Daughter or Daughters share and share alike And I d o hereby charge all my real and personal Estate with the payment of the s everal Sums of money Interest Annuities and Legacies aforesaid And I d o hereby direct that my said Wife Jane shall have the Tuition of my sd. T wo younger daughters and that she shall receive the Interest of their s d. Legacies for their Education and Maintenance during their Minority a nd that her receipt shall be a sufficient discharge for the same And I d o hereby Give all my real Estate and residue of my personalEstate not h erein before given or devised to my only Son Richard Hathornthwaite his H eirs and Assigns for ever Subject to the payment of all my Debts Legaci es and funeral Expenses And I do here byname and appoint my said Son R ichard Hathornthwaite sole Executor of this my last Will and Testament In Witness whereof I have hereunto set my hand and Seal this thirtiet h day of October in the year of our Lord one thousand seven hundred and f ifty seven. 1757.
