This is the last Will and testament of me Thomas Hathornthwaite lat e of Barns End in Quarmore in the County of Lancaster but now of Old To wn in the County of Westmorland Yeoman made published and declared the T wenty Fifth day of November in the Year of our Lord One Thousand Eight h undred and nine in manner and form following that is to say     In the f irst place I order and direct that all my just Debts Funeral and testam entary Expenses shall be paid off and discharged by my Executors herein after named out of my personal Estate.  In the next place I give and be queath unto my Daughter Hannah the Wife of George Croskell of Ellel in t he said County of Lancaster Yeoman the Sum of Three hundred Pounds of l awful Money of Great Britain to and for her sole and separate use and b enefit, and the same is not to be subject or liable to the Debts Contro ll or engagements of her said Husband in any wise and her Receipt or re lease alone notwithstanding her coverture is to be the only good and va lid discharge to my Executors for the value and should my said Daughter d ie in my Life time then and in such case I give the said Legacy or Sum o f Three hundred Pounds equally amongst all her children share and share a like to be paid to them when and as they shall respectively attain the A ge of Twenty one Years with Interest in the mean time,such Interest to b e paid yearly by my Executors towards their Education and support.  I a lso give and bequeath unto my Grandson Iram Whitehead the Son of my lat e Daughter Elizabeth Whitehead the Legacy or Sum of Three hundred Pound s of lawful Money of Great Britain to be paid him by my Executors out o f my personal Estate or out of the Estates hereinafter devised to my Gr andson Thomas Hathornthwaite at the end of twelve calendar Months next a fter my decease.  I give devise and bequeath unto my Grandson Thomas Ha thornthwaite all my Messuage and Tenement situate lying and being in Qu armore aforesaid commonly called and known by the Name of Barns End con sisting of a Dwelling House, Barns Turfhouse and outbuildings Orchard a nd garden and of about twelve Acres of Land more or less thereunto belo nging and now in the possession of James Dilworth as my Tenant, to hold t he same with the Appurtenances unto him my said grandson Thomas Hathorn thwaite his heirs and Assigns forever or for and during all my term Est ate and Interest therein.  I also give and devise unto my Son James Hat hornthwaite  and his Assigns all that Messuage and Tenement situate lyi ng and being in Scotforth in the said County of Lancaster commonly call ed and known by the Name of Patchetts with the Buildings Lands and Appu rtenances thereunto belonging, together with the Allottments of Common o r Parcels of land situate and being on Scotforth Moor latly allotted an d set out to me for and in respect of my Hereditaments and Premises in S cotforth aforesaid, to hold to him my said Son James Hathornthwaite  an d his Assigns for and during the term of his natural Life, and from and i mmediately after the decease of my said Son James Hathornthwaite I give a nd devise the same Messuage and Tenement Lands Hereditaments and Premis es situate in Scotforth aforesaid and the Allottments of Common aforesa id with the Conveniences and Appurtenances unto my said Grandson Thomas H athornthwaite his Heirs and Assigns forever.  All the rest residue and r emainder of my Monies and Securities for Money Goods Chattels Personal e state and Effects whatsoever and wheresoever and of what nature kind or q uality soever I give devise and bequeath unto John Whitehead and Iram W hitehead hereinafter named their Executors & Administrators forever or f or and during all my Estate and Interest therein upon trust that they p ay there out all my just Debts funeral and testamentary expences and th e Legacies by me herein before given and bequeathed and pay the overplu s of the Moneys, if any, unto the use of my said Grandson Thomas Hathor nthwaite.  And it is my Will and Mind and I hereby order and direct tha t my said Executors shall have full power and authority to Devise and L et the said Hereditaments  and Premises devised to my said Grandson Tho mas Hathornthwaite during his Minority and receive the Rents and Profit s thereof and pay and apply the same Rents and Profits to and for the M aintenance Education and bringing up of my said Grandson until he shall a ttain his Age of Twenty one Years.  And lastly I hereby revoke all Will s by me at any time heretofore made and of this my last Will and Testam ent do constitute and appoint the said John Whitehead of Banton House i n Ellel in the said County of Lancaster and the said Iram Whitehead joi nt Executors in Trust.   In witness whereof I have hereunto set my hand a nd seal the Day and Year first herein before written

The within named Testatator died on the fifteenth Day of April in the Y ear of our Lord 1810.
On the Nineteenth Day of May in the Year of our Lord one thousand eight h undred and ten this Will was proved in Common Form and John Whitehead o f Banton House in Ellel in the County of Lancaster Farmer and Iram Whit ehead of Old Town in the County of Westmorland Farmer the executors the rein named were sworn well and faithfully to execute and perform the sa me and so forth and that to the beat of their knowledge and belief the w hole of the personal Estate and Effects of which the Testator within na med died possessed within the Archdeaconry of Richmond in the diocese o f Chester did not in real vale amount to the Sum of Six hundred pounds
