Will of James of Cabus 1776

In the name of God amen, I James Hawthornthwaite of Cabus in the Pari sh of Garstang and County of Lancaster Husbandman being weak of Body bu t of sound and disposing Mind and Memory (blessed be God for the same) d o make this my last Will and Testament in manner and form following (th at is to say) First I give and devise all that my Messuage and Tenement w ithin Cabus aforesaid, now in the Possession or Occupation of me and Ja mes Thornton my Undertenant with the Appurtenances unto James Hawthornt hwaite my Oldest Son his Heirs and Assigns for and during all the Resid ue and Remainder of the Time Term or Space I may fortune to have any In terest therein by Virtue of One Indenture of Lease Granted me by the Ri ght Honourable Lord Archibald Hamilton. Then I give and bequeath to Th omas my younger Son, and to Margaret my Daughter, the Sum of Ninety Pou nds, to be equally divided between them share and share alike; which sa id Sum of Ninety pounds I hereby Order to be paid out of my personal Es tate to them the said Thomas and Margaret my Son and Daughter in such P ortions as are herein before mentioned of and concerning the same at th e End and Expiration of Twelve Months next after the time of my Decease . And if my said executors cannot with safety pay the one half part of t he said Sum of Ninety Pounds to my said Son Thomas at the End or Expira tion of the Twelve Months next after the Time of my Decease, on account o f his not having attained the Age of Twenty One years; then and in such c ase I order and direct that the said Share of the said Thomas shall car ry Interest from the End of Twelve Months next after the time of my Dec ease till the said Thomas shall attain the said Age of Twenty One years ; and that all the Interest, which shall arise as aforesaid, shall be p aid to him the said Thomas together with his said Share or half part of t he said Sum of Ninety pounds at his attainment to the said Age of Twent y One years As to all the Rest Residue and Remainder of my personal E state of what Kind or Nature soever, I give and bequeath the same and e very part thereof to the said James my Older Son. And I do hereby nomin ate constitute and appoint my very good Friends William Dilworth and Th omas Dilworth both of Lancaster aforesaid Merchants Executors of this m y last Will and Testament, hereby revoking and making void all Wills by m e at anytime heretofore made. In Witness whereof I the said James Hawt hornthwaite the Testator have to this my last Will set my Hand and Seal t his fourth day of November in the year of our Lord One Thousand seven h undred and Seventy One

The Bearer Thos. Hawthornthwaite Son of J ames called on us and produced to us a Will of his Fathers wherein we o bserve he left us Executors. He dyed several Years ago, but we never be fore now heard of his having made such a Will. The Son is now desirous t o prove the said Will,but on perusing it we find, the matter is so smal l a Compass, and this son of age sufficient to transact the business we c huse to renounce the said Executorship and are with due respect thy [il leg] Friends
