 In the name of God Amen the twenty sixth day of October in the yea r of the Ld God one  thousand seven hundred & six   I James Hathornthwa ite of Lodge in Quarmore in  the County of Lancaster  yeoman being aged a nd infirm but of sound& alert minde &  memory thanks be to God for the s ame & considering the frailty of human life &  beeing desirous to sette t hings in order & quietness after my decease doe make &  ordaine this my l ast will & testament in manner followinge   And first I commend my  Sou l to my Creator God Almighty trustinge thro' the meritts of Jesus Chris t my Saviour  to inheritt the Kingdom of Heaven   And my body I comitt t o the earth to be buried  in decent and orderly manner at the discretio n of my Executor hereafter named And for  my temporall estate I give & d evise the same as is herein hereafter [   ] and  expressed  And I doe h ereby revoke all former & other Will & Wills by me formerly  made   And d oe declare this to be my last Will& testament  First it is my will& min d  that all charity dues &rights for my funerall be paid & that all my d ebts legacies & funerall  expenses bee satisfied & discharged   And I d oe hereby give & devise unto John Hathornthwaite my Sonn & his heirs Al l that my messuage & tenement commonly  called & known by the name of L anshaw in the pish of Clapham & County of  Yorke Item  I give & devise a ll of my other messuage & tenement lyinge & beeinge in  the sd pish of  Clapham commonly called & known by the name of Old Walters[Walkers?] of   the yearly rent of five shillings & two pence with the appurtenances th ereto belonging  unto my sd Sonn John Hathornthwaite & his heirs   Item   I give & devise unto  my sd Sonn John Hathornthwaite & the heires of h is body lawfully to bee begotten  all that my messuage & tenement with t he appurtenances situate lyinge & beeinge att  Bolton by the Sands in t he sd County of Lancaster   And for want of heires of the body of  my s d Sonn John I doe devise& give the sd messuage & tenement att Bolton  a foresd unto my Sonns Thomas Hathornthwaite& James Hathornthwaite &  the ire heires equally betwixt them without any benefitt of survivor Spp to   be had or taken by either or any of them & in case my sd Sonns Thomas o r  James or either of theire heires offerr to [insist] upon the benefit t or advantage  of Survivor Spp contrary to my will & mind then it is m y will & mind that  Such of them soe obstructing this my last will & te stament shall have noe parte or  share of the sd messuage & tenemement a tt Bolton aforesd   But if the other of my  Sonns submittinge & conform inge to my sd Will & mind & his heires shall have & enjoy the whole mes suage & tenement att Bolton aforesd   Item it is my will &  mind that t he standinge goods as [Arks?] bedstocks chairs & tables in the house at t Bolton  shall stand & remain there as heirelooms & that my sd Executo r shall not medle  therewith Item  I doe hereby give &devise unto Thoma s Hathornthwaite my  Sonn & his heires All that my messuage tenement & l ands with all appurtenances  commonly called Lodge with[in?] Quarmore a foresd  Item I do hereby give &devise  unto my sd Sonn James Hathornthw aite & his heires All that my messuage  & tenement with all appurtenanc es commonly called Stable Oake situate lyinge  & beeinge in the Forest o f Bolland & pish of Slaidburn in the sd County  of Yorke & alsoe my Wat er Corne Mill there & also all those my lands  & grounds commonly calle d the Higher Stable Oake with all appurtenances  thereto belonginge   A nd I do hereby charge the messuage tenement Mill Lands & Premisses att S table Oake with the payment of the Sum of one hundred  & sixty pounds t o be paid to the psons hereafter named pd in manner followinge  that is t o say with the payment of twenty pounds to Grace wife of Richard Haight on  within one yeare after my decease & with the payment of twenty one s hillings &  six pence to Richard Haighton in the liketime  And with the p ayment of the sume  of seventy pounds to David Hathornthwaite sonn of T homas Hathornthwaite  aforesaid when he shall attaine the age of twenty o ne yeares And with the payment of the  Sume of Sixty Eight pounds eight een shillings & sixpence to Jane Haighton  my granddaughter when she sh all attaine the age of twenty one yeares  And it is  my will & mind tha t upon failure of payment of any of the sd summes as the same shall  be come due or securing the payment thereof of the sd psons or any of them t o  whom thesd sumes are hereby given & charged shall & may lawfully ent er into  the said premisses hereby charged therewith& to hold & enjoy t he same till the sd sumes  are thereout respectively paid & satisfied  I tem I doe give to my sd Grand daughter Jane Haighton the sume of therty o ne pounds one shillinge and  sixpence out of my personall estate when s he shall attaine the age of  twenty one yeares   Item  I give to my sd g rand-daughter Jane Haighton a debt of twelve  pounds with all interest t hereon due owinge  to me by John Haighton Snr late  father   Item it is m y will and mind that my Executor hereafter named shall  maintaine & kee pe my sd grand daughter Jane Haighton with meate  drinke apparell & oth er necessarys suitable to her degree & quality  till she shall attaine t he sd age of twenty one yeares  Item  I give to the  sd Jane Haighton t he bedd & beddinge whereupon I now lye   Item I  give to my sd sonns Jo hn Thomas & James Hathornthwaite there Executors  [---s]& [assigns?] Al l that my messuage & tenement with all the appurtenancesatt Marshaw  in O verwyersdale equally amongst them without any benefitt or  advantage of s urvivor Spp to be had or taken by them or any of  them on paine of forf eiture of his or theire share & shares that shall  soe offerr to doe    I tem after my debts legacies & funerall expenses pd  I give all the rest r esidue & remainder of my psonall estate to my [said?]  sonn James
