Page 1 This is the last will and testament of me Richard Hathornthwia te of Lower Lee within the township of Overwyersdale in the county of L ancaster Gentleman made whilst I am of sound mind……………….
Whereas a certain field or close of land in Overwyersdale aforesaid c alled or known by the name of the Benthill and containing in the whole b y estimation eight acres or thereabouts has heretofore belonged to and w as part of my tenement or Estate in Over Wyresdale aforesaid called th e Higher Lee And whereas several years ago I took and separated a pi ece of ground containing about two acres from off the said Close called t he Benthill lying behind the Crow Trees upon and at my tenement and est ate at and called Lower Lee in Overwyersdale aforesaid and added and la id the same piece or parcel of Ground so taken off the said field or c lose called the Benthill to my said tenement or estate called the Lower L ee aforesaid and I have called the same field or piece of ground by the n ame of the mill race field: and whereas I lately …………………………….
Page 2 [my trustees] do permit and suffer Robert Bradshaw of Lanca ster aforesaid Tallow Chandler and my relation Mary Ann Bradshaw his wi fe or the survivor of them to live in possess hold and enjoy the messua ge or dwelling house wherein I now reside at Lower Lee aforesaid and th e household goods furniture books plate bed and table linen and all oth er implements of housekeeping which may be therein at the time of my de cease …………….. until the eldest or other son of the said Robert Bradshaw o r other person to whom an estate for life or an estate in tail is herei nafter and hereby given and limited……. called Lower Lee shall first att ain the age of twenty five years but upon Condition and so that the sai d Robert Bradshaw and Mary Ann Bradshaw his Wife of the Survivor of the m shall and do reside in hold and enjoy my messuage or Dwelling house a nd other Buildings Orchard [Page 3] and Garden at the Lower Lee aforesa id

Page 4 And after the decease of the said John Bradshaw To the use of t he first and every other son of the said John Bradshaw according to the ir several and respective Seniorities in tail male And for the want of s uch Issue To the use of Thomas Bradshaw, the second son of the said Rob ert Bradshaw by his said present Wife and his assigns for and during hi s natural Life without impeachment of Waste, and………. [then, similarly, t o Robert Bradshaw third son of Robert Bradshaw]
Page 5 …….. and for want of such issue [of Robert Bradshaw the son] To t he use of John Walmsley the younger, the eldest son of my relation Joh n Walmsley the older late of Lancaster aforesaid but at present residen t in the Island of Martinique or elsewhere in the West Indies merchant, a nd his assigns………… [then to the sons of John Walmsley in order,then, f or want of such sons, to John’s brother James Walmsley and then his son s etc etc]

Page 9 Provided also and I do hereby declare my will and mind to be a nd I do hereby request that all and every person and persons who by vir tue of any of the limitations in this my will contained or any of them s hall and may become seized or entitled to any estate freehold or Inheri tance of or in my said messuages tenements estates and hereditaments ca lled the Lower Lee and Higher Lee aforesaid do within six calendar mont hs next after he or they shall become so seized or entitled if he or th ey shall be of full age and if not then within six calendar months next a fter he or they shall attain the Age of twenty one years assume and tak e upon himself or themselves respectively and use the Sir[sic] name of H athornthwaite only in addition to his or their Christian name and shall a lso take and bear the family arms of Hathornthwaite and shall according ly apply to obtain her Majesty’s sign manual licence and consent or suc h other authorities as shall be necessary for that purpose.
Page 10 I give and devise all that my messuage tenement and Estate ca lled Chapel Croft situate at Newton in Bolland in the County of York …… ………… unto my relation George Parker of Malton in the said County of Yo rk, Surgeon for and during the term of his natural life…….
Page 12 And whereas I have had it in contemplation for some time past t o erect six cottages or dwelling Houses and necessary offices thereto a nd make a small Garden to be attached to each cottage in or upon part o f the said close called the Benthill near adjoining to the public Road l eading towards Tarnbrook in Overwyersdale aforesaid for the succour and h abitation at all times hereafter forever of poor destitute widows or ot her unmarried Women of good morals and character belonging to Overwyers dale aforesaid and also to build a School house adjoining thereto to be e mployed principally as a Sunday School but also to be employed (at the d iscretion of the trustees thereof……) in any proper useful and commendab le mode of instructing youth at other times and I have marked staked an d set out the Grounds which I have considered necessary for these purpo ses and have made some Progress in this my desire scheme and intention a nd it is also my intention to endow the said Cottages with five pounds p er annum ……….
[Gives Tongue Moor,Littledale, to his Executors in Trust to be sold wit hin 5 years as a whole or in parts]
