Will of Robert of Dinkling Green 1841
In the name of God Amen, I Robert Haythornthwaite of Little Bowland i n the County of Lancaster Yeoman being of sound mind memory and underst anding for which I praise God do make publish and declare this my last W ill and Testament in manner and form following and first it is my will a nd mind and accordingly I order and direct all and every my just debts a nd funeral expenses and the charge of the probate of this my Will to be p aid discharged and satisfied for from forth and out of my personal esta te and effects and also all other cost charge and expenses attending th e due execution thereof by my Executors hereinafter named as soon after m y decease as conveniently may be………..And then I give and bequeath unto m y daughter Betty wife of John Bourn the sum of One Hundred Pounds
Also unto my Grandaughter Mary wife of Richard Langton the s um of Nineteen Pounds nineteen shillings…….Likewise unto Ellen the daug hter of Mary Langton the sum of Nineteen pounds nineteen shillings to b e paid unto her when she attains to the age of twenty one years, and th e interest thereof to be paid or applied to her use yearly in the meant ime. Likewise I give and bequeath unto my son Major (in case he return s from America) the sum of Five Pounds. Also unto the widow of my son J ohn the sum of five shillings which said legacies are to be paid unto t hem or their respective lawful representatives at the end of twelve mon ths after my decease. All the rest residue and remainder of my money, P ersonal estate and effects whatsoever I give and bequeath unto and equa lly between my two Grandsons Robert and John Haythornthwaite being the s ons of my son Major, their respective Heirs and Assigns. Likewise I gi ve devise and bequeath unto my son Edward Haythornthwaite all that my F reehold estate, situate lying and being in Bashall Eaves, known by the n ame of Talbot Tenement, and now in the tenure and occupation of Thomas H ayhurst, to have and to hold the same withall and every the appurtenanc es unto and to the use of my said son Edward Haythornthwaite his Heirs a nd Assigns for ever. Also I give and bequeath the yearly sum of five p ounds per year unto my my said son Edward, for and during the term of h is life. Likewise the yearly sum of Ten Pounds per year to be paid unt o my son Richard Haythornthwaite for and during the term of his life. A nd also I give and bequeath the yearly sum of Ten Pounds per year to be p aid unto my Grandson Robert Haythornthwaite (being a Child of my son Ed ward's) for and during the term of life…..to be paid and payable to eac h and every of them from my Freehold Estate, situate at Dinckla Green i n Little Bolland in the County of Lancaster, by two equal half yearly p ayments, in each and every year for and during their respective lives, t he first payment to begin and to be made at the end of six months after m y decease. And the residue and remainder of the yearly rents issues a nd profits arising from my said Freehold estate I order and direct to b e paid by my Executors as the same becomes due unto and equally betwee n my two Grandsons Robert and John Haythornthwaite their respective Hei rs and Assigns (they being the Children of my son Major) for and during t he term of seven years, after my decease, unto whom I give and bequeath t he same. And then after the term of seven years after my decease, and c harged and chargeable with the aforesaid yearly payments I give devise a nd bequeath my aforesaid Freehold Estate, situate at Dinkla Green, with t he buildings, Lands, Grounds,Hereditaments and appurtenances thereunto b elonging or in anywise appertaining unto and to the use of my two Grand sons Robert Bourn the son of my Daughter Betty and Robert Walker the so n of my Daughter Lettice, their respective Heirs and Assigns for ever, s hare and share alike as tenants in common, and not as joint tenants, b ut provided that that in case my Grandson Robert Bourn die in the meant ime and leave no lawful issue,then his part or share provided for him i n this my Will I give devise and bequeath unto his brother Nicholas Bou rn his Heirs and Assigns for ever.
And also that in case my Grandson Robert Walker should die i n the meantime and leave no lawful issue, then his part or share provid ed for him in this my Will, I give devise and bequeath unto and to the u se of his brother Richard Walker his Heirs and Assigns forever. Likewi se I give devise and bequeath all that my part or share of an Estate kn own by the name of the Rakefoot, situate in Chaigley in the County of L ancaster, unto and to the use of my two Daughters Betty wife of John Bo urn and Lettice Widow of Richard Walker for and during their respective l ives; equally betwixt them share and share alike. And then immediately a fter my said Daughter Betty Bourn’s decease I give and devise the one h alf part of my share in that estate unto and to the use of my Grandson R obert Bourn his heirs and Assigns for ever.
And also immediately after the death of my Daughter the sai d Lettice Walker, I give and devise my other half part of my share in t he said Estate unto and to the use of my Grandson Robert Walker his Hei rs and Assigns for ever.
And lastly I nominate and appoint myson in law John Bourn o f Aighton in the County of Lancaster, Yeoman, and my friend John Helmn( ?) of Great Bowland in the County of York Farmer Executors of this my W ill hoping as my trust is in them reposed, that they will faithfully ex ecute the same.
Provided and my will and mind is that they shall and may re imburse themselves, and himself respectively, all such cost trouble and e xpenses as they shall lay out expend or be put into for or by reason of t his my Will And that they shall not be answerable one for the other but e ach of them answerable for his own Acts, Neglects and Receipts only,nor f or any loss that may happen, unless such loss happen through their coll usion, or wilful neglect and default. And disannuling and making void a ll former Wills declare this to be my last Will and Testament, In Witne ss whereof I the said Robert Haythornthwaite the Testator have to this m y Will contained in one sheet of paper set my Hand and Seal this twenty s eventh day of October One Thousand eight hundred and thirty seven (1837 ) (the word “Grand” being interlined)
