Will of John Hathornthwaiteof Tarnbrook 1658/9
In the name of God Amen the first day of march in the yeare of our Lord G od one thousand sixe hundred fiftyeight according to the computation o f the Church of England I John Hathornthwaite of Tarnbrooke in Wyresda ll in the County of Lancaster yeoman being sick in bodie but whole in m ynd and of perfect memory and remembrance blessed and praised bee Almi ghty God for it doe make and ordayne this my last Will and Testament in m anner and forme following First I bequeath my soule into the hands o f Almighty God my Maker hopeing that through the meritorious death and R esurrection of Jesus Christ my only Saviour and Redeemer to receave fre e pardon and forgiveness of all my sinnes and to be one of his elect an d chosen to live with him in his Everlasting Glory And my bodie to b e buried in Christian buriall in the parish Church yard of Lancaster a t the discretion of my Executors
And as for my worldly Estate I give and bequeath as followeth First af ter my debts and funerall expenses being discharged forth of the whole I give and bequeath the full halfe of all my houses buildings and barne s whatsoever and alsoe the full halfe of all my lands and Tenements to a ll and every of the full halfe part lyinge at the Vaccary of Tarnbrooke a nd at the Vaccarie of Marshaye unto Richard Hathornthwaite my deere an d lovinge sonne payinge unto my daughter Elizabeth Hathornthwaite the f ull whole and [just?] summe of Twenty three pounds six shillings eight p ence of lawfull money of England at two equall portions that is to say t he first moyety or halfe part of the summe aforesayd at and upon the s econd day of February which shall be three yeares after the decease of h im the sayd John Hathornthwaite father to the sayd Elizabeth and the la tter moyetie or other halfe part at the other third yeares end followi nge Item I give and bequeath unto John Hathornthwaite and Edwa rd Hathornthwaite my deere and lovinge sonnes the other halfe part of a ll my buildings houses barnes lands and Tenements lying at the Vaccarie o f Tarnbrook and at the Vaccarie of Marshay equally between them paying u nto my sonne Thomas Hathornthwaite the full whole and [just?] summe of T enn pounds of lawfull money of England within foure yeares after the d eath of him the sayd John father to him the sayd Thomas at one whole a nd entyre payment which payment to bee paid equally by both the sayd Jo hn and Edward his brother And likewise my will and mynde is that m y two sonnes John and Edward shall paye unto my sonne Nicholas Hathorn thwaite the full whole and [just?] summe of five pounds of lawfull mo ney of England at one whole and entire payment within five years after t he death of him the sayd John Father to him the sayd Nicholas And l ikewise my will and mynde is that my two sonnes John and Edward shall p ay unto my sonne Lawrence Hathornthwaite the full whole and [just?] sum me of five pounds at one whole and entyre payment of lawfull money of E ngland within sixe yeares after the death of him the sayd John father t o him the sayd Lawrence which payments equally to be paid betweene the s ayd John and Edward And alsoe my will and mynde is that Alice my W ife shall have the bedchamber above the fyre in her third part And fu rthermore I make and ordayne John Hathornthwaite and Edward and Richar d Hathornthwaite my three deere and lovinge sonnes my whole Executors h opeinge as my trust is in them that they will see this my will performe d in witness whereof I have put my hand and seale the day and yeare fi rst above written

Also my will and mynde is that my sonne Richard shall have and enjoy a ll the halfe part of my buildings lands and Tenements as is herein expr essed to him and his heyres for ever performing the legacies as is here in expressed and the other halfe part to my sonnes John and Edward to t hem and their heyres for ever performing the legacies. I John Hatho rnthwaite of Tarnbrook Doe confesse myselfe to stand indebted unto my s onne Richard Hathornthwaite of nineteen pounds due to be paid unto him t he sayd Richard Hathornthwaite I John hathornthwaite have oweinge unto m e of William Waller of [Stors?] [near?] [Acrain/Arwain?] the summe of t hirteen shillings And the sayd John Hathornthwaite do edeclare thus u pon his will in the [presence?] of [ ] And furthermore the sa yd John Hathornthwaite doe declare upon this his will that his sonne E dward shall have foure yards of one web of cloath which is at dressing a t the [Weaver?] And his daughter Elizabeth one yard and a halfe, and f urthermore that his wife shall have as much of the woollane yarne when i t is made into Cloath it now beinge in spinning as shall make her pett icoate and wastcoate And likewise that there is one Webb of Cloath a t Lancaster that [four] of my eldest sonnes shall have[every] of them a p ayce of stockins cloath and [the] remaynder over of them all to be sol d except one petticoate cloath for my daughter Elizabeth And lik ewise of that webb which is in spinninge my mynde is that my sonne Tho mas shall have three yards of it

This Will was proved at London before the judges for probate of Wills a nd graunting Administrations on the one and Twentieth day of May in the y eare of our Lord God one thousand sixe hundred fifty nyne by the oath o f Edward and Richard Hathornthwaite Executors unto whome was committed A dministration they being first by commission [ ][truely] to Ad minister.

I attach a transcription of the Will of John of Tarnbrook, Yeoman, 1658 /9. This comes from a microfilm held at the Public Record Office at Kew . The Will was proved in London under the civil system in force under t he Commonwealth 1652-1660.
Until now, we only had Dorothy Haythorn Collins' brief summary of this w ill. Having seen the full text, I think it clinches the hypothesis that o ur ancestors came from Tarnbrook. However, it now perhaps seems most li kely that Edward of Dinkling Green was the son of this John of Tarnbroo k. Previously, I had inclined to the view that Edward of DG was a son o f Richard of Tarnbrook, eldest son of John,and will now have to slightl y alter my tree. If you have any thoughts on the balance of probabiliti es, or any tests that might be applied, please let me know.
